Your statutory rights. Nothing in these Terms affects your legal rights as a consumer under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. Where any term conflicts with those rights, your statutory rights prevail.
1. Background
1.1 These general terms and conditions (the "General Conditions") govern the sale of products by Atelier Printworks to you as a consumer (the "Customer") through the website www.atelierprintworks.com and its associated pages (the "Website"). The agreement is made between you and Atelier Printworks. Detailed contact information and other pertinent details about Atelier Printworks can be found on the Website. These General Conditions apply specifically to consumers.
1.2 To place an order through the Website, the Customer must be a minimum of 18 years old. In accordance with Scottish law, Atelier Printworks does not accept credit purchases from individuals below the age of 18. Atelier Printworks reserves the right to refuse or amend a Customer's order (e.g., if the Customer has provided incorrect personal data and/or has any history of non‑payment of debts).
1.3 Atelier Printworks bears no responsibility for products being out of stock or for any image or typographical errors on the Website. This includes errors in product descriptions or technical specifications, inaccurate prices, price adjustments, or incorrect information regarding product availability. Atelier Printworks reserves the right to rectify such errors and to modify or update information at any time. In the event of an inaccurate price listed for a product ordered by the Customer, Atelier Printworks will inform the Customer and await their approval of the amended price before proceeding with the order.
Please also note that actual product colours may vary slightly from those displayed on your screen. Variations in monitor settings, screen calibration, and ambient lighting can affect how colours are perceived. While we make every effort to ensure accurate colour representation, an exact match between on‑screen images and the final printed product cannot be guaranteed.
1.4 The Website and all its content are owned by Atelier Printworks or its licensors and are protected by intellectual property and marketing legislation. This includes trademarks, company names, product names, images, graphics, designs, layouts, and information about products, services, and other content, which may not be copied or used without prior written consent from Atelier Printworks.
2. Contracts and Orders
2.1 By placing an order through the Website, the Customer agrees to abide by the General Conditions. By accepting the General Conditions, the Customer confirms their compliance with these terms and acknowledges having read the information on personal data and cookies, consenting to their use according to Atelier Printworks' Privacy Policy.
2.2 A purchase contract is established when Atelier Printworks confirms the Customer's order and the Customer receives an order confirmation via email. Atelier Printworks advises Customers to retain their order confirmation email for future reference. Customers can cancel their orders before confirmation by Atelier Printworks. If an order is cancelled, Atelier Printworks will refund any payments made by the Customer or their payment or credit card company regarding the order.
3. Customer Information
3.1 When registering a user account and/or placing an order, the Customer must provide certain personal data. The Customer confirms the accuracy and completeness of the provided information and is responsible for any errors. Information about the processing of personal data is detailed in Atelier Printworks' Privacy Policy.
3.2 The Customer agrees not to disclose their login details to any unauthorised individuals and to notify Atelier Printworks promptly if unauthorised access is suspected. The Customer is responsible for all purchases made with their login details if such notification is not provided.
3.3 If Atelier Printworks suspects misuse of a user account or login details, or any violation of the General Conditions, Atelier Printworks reserves the right to block access to the user account and assign new login details to the Customer.
4. Specific Terms for Digital and Computer‑Generated Artwork
4.1 Service Description. We work with a mix of independent artists and our own in-house designers to create the artwork we sell. Some pieces are made using digital tools and software; others are drawn, painted, or produced by hand. However a design comes about, we prepare and print each one carefully so it arrives ready to hang and looking its best.
4.2 Uniqueness of Content. While we strive to ensure that all designs are original, due to the vast number of artworks worldwide, we cannot guarantee that some pieces may not bear resemblance to existing or pre‑existing works.
4.3 Usage Rights. All intellectual property rights in the artwork, software, and content on the Atelier Printworks Website remain the property of Atelier Printworks or its licensors and are protected by copyright laws and treaties. When purchasing artwork from Atelier Printworks, you are granted rights for personal use only. Any commercial use, reproduction, or distribution requires prior written consent from Atelier Printworks.
4.4 Artistic Interpretation. The appreciation and interpretation of artwork—whether computer‑generated or otherwise—is subjective and may vary by individual. No specific meaning, intention, or message is implied in the design unless expressly stated.
4.5 Interpretation and resemblance. Atelier Printworks is not responsible for any subjective misinterpretation of, or perceived resemblance in, the artwork. This clause does not affect your right to return items or to a refund or replacement for damaged, defective, or incorrect goods, which are dealt with in Section 9 and under applicable consumer law.
4.6 Risk Acknowledgment. By purchasing artwork from Atelier Printworks, you acknowledge that use and application of the artwork are at your own risk. Subject to Section 17 and your statutory rights, we are not liable for claims, damages, or losses resulting from how the artwork is used or its suitability for any particular context.
4.7 Content Review. Atelier Printworks reserves the right to review and withhold any content or designs that are deemed inappropriate or offensive, at our sole discretion.
4.8 Changes to Terms. Atelier Printworks may revise or update these terms in accordance with Section 13. Customers are encouraged to review the terms periodically.
5. Prices, Fees, and Payment
5.1 The prices listed on the Website apply to orders placed there. All prices are presented in Great British Pounds. Payment and shipping fees are provided separately.
5.2 Payment can be made via the methods specified on the Website. Atelier Printworks may charge the Customer upon order confirmation, unless another approved payment method has been selected. All payments are processed securely with Shopify. Atelier Printworks does not store any payment card details, and transactions are handled through trusted third‑party payment providers.
5.3 Payment is taken at the time the order is placed, not at dispatch. Your order will only be processed once payment has been successfully completed.
6. Special Offers
Atelier Printworks may offer special promotions on the Website with conditions more favourable than those in these General Conditions, such as an extended right of withdrawal or payment terms. Such conditions apply only for the specified duration and products indicated by Atelier Printworks. Atelier Printworks reserves the right to withdraw these special offers at any time, with the General Conditions applying thereafter. Offers on specific products are valid for a limited time and until products are sold out.
7. Gift Card
Gift cards sold by Atelier Printworks are valid for two (2) years from the date of issue and can be redeemed on the Website. After the expiry date, the card cannot be used or reactivated, nor can remaining value be reimbursed. Gift cards constitute legal tender at Atelier Printworks and must be stored securely. They cannot be exchanged for cash, and lost or stolen cards will not be replaced. Gift cards cannot be combined with discount codes.
8. Delivery and Shipping
8.1 Products in stock are typically delivered within the specified number of working days as indicated on the Website. Delivery will occur no later than 30 working days after order confirmation, unless otherwise agreed.
8.2 The expected delivery time is provided in the order confirmation and checkout process. If delivery is delayed for more than 30 working days, the Customer may cancel the purchase, provided the delay is not due to the Customer. Please note that international orders may be subject to customs inspections and delays, which are beyond our control. Atelier Printworks is not responsible for delays caused by customs processing.
8.3 If a package requires pickup, the Customer must do so within the specified time. Failure to retrieve packages may result in a fee. Home delivery requires someone to accept the parcel.
8.4 Incorrect or incomplete delivery details. It is the Customer's responsibility to provide a complete and accurate delivery address and contact details at checkout. Atelier Printworks is not liable for failed, delayed, or misdirected delivery, or for loss of the order, where this results from an incorrect, incomplete, or outdated address or contact information supplied by the Customer. Where an order is returned to us as undeliverable for this reason, we will contact the Customer to arrange redelivery; any additional postage or re‑shipping costs will be payable by the Customer. Where an order cannot be recovered because of an incorrect address, we are not obliged to provide a replacement or refund. Customers should check their order confirmation carefully and contact us as soon as possible if any details are wrong, so we can attempt to amend the order before dispatch.
9. Returns, Exchanges, and Right of Withdrawal
9.1 In addition to the statutory 14‑day cancellation right for distance sales, Atelier Printworks offers Customers the right to return their order within 30 days of delivery. To qualify, the item must be unused, in its original condition, and returned in its original packaging. Once the item has been received and inspected, a refund will be issued for the product cost.
9.2 To initiate a return, the Customer must contact Atelier Printworks within the 30‑day period and provide their order number and details of the request. Items should not be returned without prior approval.
9.3 Return addresses. Orders delivered within the United Kingdom and Europe must be returned to our UK returns address. Orders delivered within the United States must be returned to our US returns address. The correct return address will be provided once the return request has been approved.
9.4 The Customer is responsible for return shipping costs unless the item is damaged, defective, or incorrect. The Customer must ensure the item is returned safely and provide a valid tracking number for the return shipment. Atelier Printworks reserves the right to reduce a refund if the item is damaged due to inadequate packaging or handling beyond what is necessary to inspect it.
9.5 If an item arrives damaged, defective, or incorrect, the Customer must contact Atelier Printworks within 30 days and provide order details, a description, and photographic evidence. A replacement or full refund will be provided at no additional cost to the Customer.
9.6 If a shipment is confirmed lost in transit by the carrier, Atelier Printworks will issue a replacement or full refund. This does not apply where loss results from incorrect delivery details supplied by the Customer (see Section 8.4).
9.7 Refunds are issued to the original payment method once the return is received and inspected. Please allow up to 10 business days for processing.
9.8 Original standard delivery costs will be refunded where required by applicable consumer law. Additional delivery charges (such as express shipping) are non‑refundable.
9.9 Certain products may be made to order or personalised. Where permitted by law, these may be exempt from the 14‑day cancellation right, unless they are damaged, defective, or incorrect. This does not affect your rights in respect of faulty goods.
10. Warranty and Complaints
10.1 Some products may be subject to warranties. Information on warranty periods and conditions is provided on the Website.
10.2 Customers wishing to file a complaint for a defective product must contact Atelier Printworks promptly. Complaints made within two months of discovering the defect are considered timely.
10.3 Atelier Printworks covers return freight for approved complaints.
10.4 Upon return and approval of a complaint, Atelier Printworks will refund or otherwise remedy the matter for the Customer in compliance with consumer protection legislation.
11. Links
Atelier Printworks may provide links to other websites but is not responsible for the content, protection, or confidentiality of information provided on those sites.
12. Force Majeure
Atelier Printworks is not liable for delays caused by circumstances beyond its control, such as labour disputes, extreme weather, acts of war, technical problems, or governmental orders. In such cases, both Atelier Printworks and the Customer may terminate the purchase if the situation lasts more than two months.
13. Changes to the General Conditions
Atelier Printworks reserves the right to change these General Conditions at any time. Changes become valid upon the Customer's acceptance (e.g., during a new purchase) or 30 days after Atelier Printworks informs the Customer. The version of the General Conditions that applies to an order is the version in force at the time the order is placed. Customers are advised to review the Website for updates.
14. Severability
If any provision of these General Conditions is deemed invalid or unenforceable, the remaining provisions will remain valid and enforceable to the fullest extent permitted by law.
15. Applicable Law and Dispute Resolution
15.1 Disputes shall primarily be settled through agreement with Atelier Printworks' customer services.
15.2 If a dispute cannot be resolved through customer service, the Customer may pursue the matter through the courts. Nothing in these terms prevents a Customer from exercising any rights available to them under applicable consumer protection law.
15.3 These General Conditions, and any dispute concerning their interpretation or application, are governed by Scottish law and subject to the jurisdiction of the courts of Scotland.
16. Global Fulfillment
16.1 To ensure efficient and timely delivery, Atelier Printworks fulfils orders from various production and shipping centres located around the world, depending on the Customer's location. This allows us to reduce delivery times and environmental impact by minimising long‑distance shipping.
16.2 As a result, products may be shipped from different countries depending on availability and proximity to the Customer. Any customs duties or taxes incurred during international shipping are the responsibility of the Customer, unless stated otherwise.
17. Limitation of Liability
To the fullest extent permitted by law, and without affecting your statutory rights as a consumer, Atelier Printworks shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the purchase or use of our products. Our total liability to the Customer for any claim shall not exceed the amount paid by the Customer for the specific product in question.
